These Terms & Conditions ("Terms") are a legal agreement between you and the Oshudh Nirdeshika development team (Dhaka, Bangladesh; "we", "us"). By downloading, installing, or using the Oshudh Nirdeshika application (the "App") or the website oshudh-nirdeshika.web.app (the "Site"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
The App provides general reference information about medicines, diagnostic tests, and healthcare facilities in Bangladesh. It is not medical advice, diagnosis, or treatment, and it does not create a doctor–patient relationship. Always consult a registered physician or licensed pharmacist before starting, stopping, or changing any medicine. In an emergency, call 999 or go to the nearest hospital immediately — do not rely on the App.
1. The service
The App is a free, offline-first reference tool that offers: a database of medicines available in Bangladesh; lab test and health package price information; a directory of pharmacies, hospitals and diagnostic centers; and tools to create, store, print and share personal digital prescription records on your own device. Features may change, be added, or be removed at any time.
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you may use the App only with the involvement of a parent or guardian. By using the App you confirm you meet these requirements.
3. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Android devices that you own or control, for personal, non-commercial purposes, in accordance with these Terms and any applicable app-store rules (including the Google Play Terms of Service).
4. Acceptable use
You agree that you will not:
- copy, scrape, extract, resell, or redistribute the App's databases or content, in whole or in part;
- reverse engineer, decompile, or modify the App except where the law permits;
- use the App to create forged or misleading medical documents, or present App-generated records as officially issued prescriptions when they are not;
- use the App in any unlawful way or in a way that could harm any person, or interfere with the App's operation;
- remove or obscure any copyright, trademark, or attribution notices.
5. Health information — accuracy and limits
Medicine, price, facility and lab test data is compiled from publicly available sources, including references verified with the Directorate General of Drug Administration (DGDA), and is refreshed periodically. However:
- prices, availability, opening hours, and test fees change frequently and may differ from what the App shows;
- drug information may be incomplete, outdated, or contain errors;
- the App's content is never a substitute for the judgment of a qualified healthcare professional or the manufacturer's package insert.
You use the information at your own risk, and you are responsible for verifying it with a qualified professional before acting on it. If you find incorrect information, please report it to us.
6. Digital prescriptions & AI auto-fill
- The prescription feature is a personal record-keeping tool. Records you create are not officially issued medical documents unless created and signed by a registered physician.
- The AI auto-fill feature uses on-device optical character recognition. Machine reading of handwriting is inherently imperfect: extracted names, dosages, and durations may be wrong, and you must review and correct every field before saving or acting on it.
- You are solely responsible for the accuracy of records you create and for how you use or share them.
7. Third-party services and links
The App may hand off to third-party apps and services (such as Google Maps for directions or your phone's dialer), and the Site links to external websites. Those services are governed by their own terms and privacy policies, and we are not responsible for them.
8. Intellectual property
The App, the Site, their design, code, logo, and the selection and arrangement of their databases are owned by us and protected by applicable intellectual property laws. Medicine brand names, company names, and logos belong to their respective owners and appear only to identify products. No rights are granted to you other than the limited license in Section 3.
9. Disclaimer of warranties
THE APP AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ITS INFORMATION IS COMPLETE OR CURRENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES — INCLUDING PERSONAL INJURY, LOSS OF DATA, OR LOSS ARISING FROM RELIANCE ON INFORMATION IN THE APP — RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP OR SITE. WHERE LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID US FOR THE APP (THE APP IS FREE, SO THAT AMOUNT IS ZERO) OR THE MINIMUM PERMITTED BY LAW. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED.
11. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or third-party right.
12. Termination
You may stop using the App at any time by uninstalling it. We may suspend or terminate your license if you breach these Terms. Sections that by their nature should survive (including Sections 5, 6, 8, 9, 10, 11 and 14) survive termination.
13. Changes to the App or these Terms
We may modify the App and these Terms from time to time. The current version of these Terms will always be available on this page with its effective date. Material changes may also be announced in the App or its store listing. Continued use after changes take effect constitutes acceptance of the updated Terms.
14. Governing law & disputes
These Terms are governed by the laws of the People's Republic of Bangladesh, without regard to conflict-of-law rules. Disputes shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh, unless mandatory law in your country of residence provides otherwise.
15. General
If any provision of these Terms is held invalid, the remaining provisions remain in full force. Our failure to enforce a right is not a waiver of it. You may not assign these Terms; we may assign them in connection with a reorganization or transfer of the project. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the App.
